Terms of service

By using Break the Test, formerly Break the Hidden Test (the "Service"), you agree to these terms. We've tried to keep them readable. If anything is unclear, email [email protected] and we'll explain in plain language.
1. Who can use the Service
You must be at least thirteen years old to create an account. If you are under eighteen, you confirm that a parent or legal guardian has reviewed these terms and our privacy policy and consents to your use of the Service.
The Service is intended for personal, non-commercial test preparation. You may not use it on behalf of a school, tutoring company, or any other organization without our written permission.
2. Your account
You sign in with Google. You are responsible for keeping your Google account secure. We treat anyone who signs in through your Google account as you. If you suspect someone else has used your account, email [email protected] and we will help you secure it.
You agree to provide accurate information (the limited info we collect from Google) and not to impersonate anyone else.
3. Acceptable use
You agree not to:
- Reproduce, distribute, or commercially exploit our content (questions, passages, rationales, mock items, design assets) without permission.
- Reverse-engineer the Service, scrape it, or use automated tools to extract content or attempt-flow data.
- Use the Service in a way that harms other users, the Service, or our infrastructure providers.
- Attempt to access another user's account, data, or session.
- Submit deliberately false or harmful content via item flags or any other input.
4. Our intellectual property
The Service, including all questions we author, wrong-answer explanations, design assets, software code, and documentation, is owned by Break the Test and protected by copyright and other intellectual property laws. You receive a limited, non-transferable, revocable license to use the Service for personal test preparation. You do not receive a license to republish, redistribute, or sell our content.
5. Your data
You own the data you generate by using the Service: your attempts, your confidence ratings, your scores, your item flags. We use that data to deliver and improve the Service, as described in our privacy policy.
You can export or delete your data at any time. See the privacy policy for the process.
6. Third-party trademarks
SAT, AP, PSAT, Bluebook, and related marks are registered trademarks of the College Board. The College Board is not affiliated with, does not sponsor, and does not endorse Break the Test or any of its content.
ACT is a registered trademark of ACT, Inc. ACT, Inc. is not affiliated with, and does not endorse, Break the Test.
Common Application and Common App are trademarks of The Common Application, Inc. The Common Application, Inc. is not affiliated with, and does not endorse, Break the Test.
We use these marks only to describe what we help students prepare for, under nominative fair use.
7. No guarantee of test results
We will help you train pattern recognition. We will not guarantee a specific score, a specific score improvement, or a specific outcome on any test or college application. Real test results depend on many factors outside our control.
Scaled scores shown on practice tests use the College Board's published raw-to-scaled conversion table for SAT Practice Test 1. They are an estimate within roughly sixty points of a real-form score, not a prediction.
8. Beta and pre-release features
The Service is currently in active development. Some features may be incomplete, experimental, or change without notice. We may add, remove, or alter modules, item packs, scoring, and interfaces.
We currently offer the Service free of charge. We may introduce paid features in the future. If we do, we will let you know in advance and will not take away anything you already have.
9. Service availability
We aim to keep the Service available, but we do not guarantee uninterrupted access. We may take the Service down for maintenance or in response to infrastructure issues. The Service caches its interface in your browser, so it can open quickly even on a weak connection; loading new practice content requires an internet connection.
10. Termination
You can stop using the Service at any time. You can ask us to delete your account by emailing [email protected].
We may suspend or terminate your access if you violate these terms, if your use threatens the Service or other users, or if we're required to by law. We will notify you when we can.
11. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, secure, error-free, or that any errors will be corrected.
The Service is not a substitute for professional educational advice, tutoring, or counseling. Information in the Service is for general educational purposes only.
12. Limitation of liability
To the maximum extent permitted by law, Break the Test and its affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) one hundred US dollars.
13. Indemnification
You agree to indemnify and hold harmless Break the Test from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of your breach of these terms or your misuse of the Service.
14. Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.
Nothing in this section limits any rights you may have under consumer protection laws in your country or state of residence.
15. Changes
We may update these terms. If a change is material, we'll email you and post a notice at the top of this page at least seven days before it takes effect. Continued use after the change means you accept the new terms.

17. The whole agreement
These terms, together with our privacy policy, are the entire agreement between you and Break the Test about the Service. If a court finds any part of these terms unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it.
